Laplante granted the plaintiffs class action status but also extended the class to include all current and future babies born on or after Feb. 20, 2025, to a mother without legal status and a father who is not a U.S. citizen or lawful permanent resident at the time of their baby’s birth.

Khalil is a permanent resident of the United States.

He had filed an application for lawful permanent resident status last year in April, officials said, based on his marriage to Frida Muñoz, a U.S. citizen, who U.S. officials said “is connected to the Sinaloa cartel through a prior relationship with the now-deceased son of the infamous cartel leader Joaquin ‘El Chapo’ Guzman.”

“Following multiple fraudulent statements on his application to become a Lawful Permanent Resident, he was determined to be in the country illegally and removable on June 27,” the Homeland Security release stated.

He’s now a lawful permanent resident.
